Real estate rental is the operation that allows a person, "the tenant or lessee", to benefit from the use and enjoyment of a property that belongs to another person, "the landlord or owner".
In other words, real estate rental is a lease contract.
Important points:
- Decent housing: The landlord is obligated to provide decent housing, meaning housing that does not jeopardize the tenant's safety or health. They must ensure that the housing meets certain minimum standards.
- Mandatory documents and information: When signing the lease contract and during the lease term, the landlord must provide the tenant with certain essential documents. Example: the lease contract, the inventory of fixtures, technical diagnostics, charge statements, etc.
- Repairs: Repairs that are not classified as rental repairs are exclusively the landlord's responsibility throughout the lease term.
Example: replacing the boiler, repairing the roof, etc. - Rental repairs, on the other hand, are generally the tenant's responsibility.
Example: replacing a broken door handle, shower head, etc., broken by the occupant.
